What exactly does a forensic loan audit examine?

Complete document examination, transaction audit and analysis, mortgage note ownership investigation, loan pool document and transfer examination, the lender’s right to foreclose, and lender fraud or malpractice research. If any entity other than the true note holder initiates a foreclosure, that foreclosure is illegal.

What documents do I need to bring?

What are my options before the foreclosure lawsuit?

Generally five, without litigation: loan modification (changing the loan’s terms), repayment plan (spreading arrears over time), forbearance agreement (a pause on collection), short sale (settling below the balance), and deed in lieu (voluntarily surrendering the home). Banks often offer these in ways that don’t help you in the long run — an attorney can negotiate terms that actually keep your family in the home.

When should I call an attorney?

When your attempts to work with your bank are not working — but no later than when you receive the Notice of Foreclosure. In non-judicial states, a Notice of Default is usually delivered after your second missed payment, by certified mail with return receipt. Open it immediately.

Is it too late after the foreclosure sale?

Not necessarily. Depending on your state, you may hold a Right of Redemption. Many homeowners have been illegally foreclosed upon with rights still in force. Post-foreclosure litigation research covers illegal foreclosure litigation, ownership disputes and lender case-law history. Don’t just walk away because they say so.
